Welcome to CIXON GmbH and the CIXON Pro Theme! These Terms of Service govern your access to and use of the CIXON Pro Theme and related services provided by CIXON GmbH.
1. Introduction
1.1. The CIXON Pro Theme is a premium HubSpot CMS theme developed and provided by CIXON GmbH.
1.2. By accessing, downloading, or using the CIXON Pro Theme, you agree to be bound by these Terms of Service and our Privacy Policy.
1.3. If you do not agree to these Terms of Service, you are not authorized to access, download, or use the CIXON Pro Theme.
2. License Grant
2.1. CIXON GmbH grants you a non-exclusive, non-transferable license to use the CIXON Pro Theme for the purpose of building and operating websites on the HubSpot platform.
2.2. You may use the CIXON Pro Theme for a single HubSpot account. Additional licenses are required for use on multiple HubSpot accounts or domains.
2.3. You may not modify, adapt, translate, or create derivative works of the CIXON Pro Theme without the prior written consent of CIXON GmbH.
3. Intellectual Property
3.1. The CIXON Pro Theme, including all code, design elements, and associated intellectual property, is owned by CIXON GmbH and is protected by copyright, trademark, and other intellectual property laws.
3.2. You may not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices embedded within the CIXON Pro Theme.
3.3. You may not distribute, resell, or sublicense the CIXON Pro Theme without the prior written consent of CIXON GmbH.
4. Support and Updates
4.1. CIXON GmbH provides basic support for the CIXON Pro Theme, including bug fixes and minor updates, for a period of 4 weeks from the date of purchase.
4.2. CIXON GmbH may, at its sole discretion, release updates, enhancements, or new versions of the CIXON Pro Theme. You will be eligible for these updates with a valid license.
4.3. Support requests should be submitted through email via mail@cixon.de.
5. Termination
5.1. CIXON GmbH may terminate your license to use the CIXON Pro Theme at any time if you breach these Terms of Service.
5.2. Upon termination, you must immediately cease using the CIXON Pro Theme and destroy all copies in your possession.
6. Disclaimer of Warranties
6.1. The CIXON Pro Theme is provided "as is" and without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6.2. CIXON GmbH does not warrant that the CIXON Pro Theme will be error-free or that its use will be uninterrupted.
7. Limitation of Liability
7.1. In no event shall CIXON GmbH be liable for any indirect, special, incidental, or consequential damages arising out of or in connection with the use or inability to use the CIXON Pro Theme.
7.2. The total liability of CIXON GmbH shall not exceed the purchase price of the CIXON Pro Theme.
8. Governing Law and Jurisdiction
8.1. These Terms of Service shall be governed by and construed in accordance with the laws of Germany.
8.2. Any disputes arising out of or in connection with these Terms of Service shall be resolved by the courts of Potsdam, Germany.
9. Changes to the Terms of Service
9.1. CIXON GmbH reserves the right to modify these Terms of Service at any time, without prior notice.
9.2. Your continued use of the CIXON Pro Theme after any changes to the Terms of Service constitutes your acceptance of the updated terms.
